{"id":3070,"date":"2013-08-22T05:25:07","date_gmt":"2013-08-22T05:25:07","guid":{"rendered":"http:\/\/www.bakkah.net\/en\/?p=3070"},"modified":"2013-08-22T05:25:46","modified_gmt":"2013-08-22T05:25:46","slug":"citations-of-scholarly-consensus-regarding-zakaat-spent-on-general-charities","status":"publish","type":"post","link":"https:\/\/www.bakkah.net\/en\/citations-of-scholarly-consensus-regarding-zakaat-spent-on-general-charities.htm","title":{"rendered":"Citations of Scholarly Consensus Regarding Zakaat Spent on General Charities"},"content":{"rendered":"<p style=\"text-align: center;\"><em>In the Name of Allaah, the Ever-Compassionate, the Bestower of Mercy&#8230;<\/em><\/p>\n<p>A number of scholars of the past, from different <em>math-habs<\/em>, lands, and time periods, have cited <em>ijmaa&#8217;<\/em> (scholarly consensus) on the <strong>impermissibility<\/strong> of spending z<em>akaat<\/em> on general charities, like building masjids,\u00a0roads, bridges, or buying a shroud for a dead person or paying his debts. They viewed that <em><strong>&#8220;fee sabeelillaah&#8221;<\/strong><\/em> (in the way of Allaah) in the verse of <em>zakaat<\/em> recipients (9:60) was specific to the Muslim army and its battles, and some added: Battles <strong>and Hajj<\/strong>.<\/p>\n<p>The following citations from early scholars oppose the general broader understanding promoted by some later scholars and writers that <em><strong>&#8220;fee sabeelillaah&#8221;<\/strong><\/em> (in the way of Allaah) includes all types of charity and good deeds loved by Allaah:<\/p>\n<p><strong>1. Aboo &#8216;Ubayd al-Qaasim ibn Sallaam (d.224)<\/strong><\/p>\n<blockquote><p>Regarding paying the debts of the deceased, buying shrouds for him, building masjids, or routing rivers, and similar things of a charitable nature, then Sufyaan (ath-Thawree), the scholars of Iraq, <strong>and others have all agreed<\/strong> that this does not fulfill the duty of zakaat, since these are not from its eight categories.<\/p><\/blockquote>\n<p><strong>Source:<\/strong> His book,\u00a0<em>Kitaab<\/em> <em>al-Amwaal<\/em>, 2\/293.<\/p>\n<p><strong>2. Ibn Hazm (d.456)<\/strong><\/p>\n<blockquote><p>There is <strong>no dispute<\/strong> (amongst the scholars) that Allaah did not intend (by <strong>&#8220;fee sabeelillaah&#8221;<\/strong>) every good and charitable kind of thing when distributing zakaat, thus<!--more--> it is not permissible to be spent in other than the ways identified by the text, which is what I have mentioned previously (i.e. on the Muslim army).<\/p><\/blockquote>\n<p><strong>Source:<\/strong> His book, <em>al-Muhallaa<\/em>, 6\/102.<\/p>\n<p><strong>3. Ibn al-&#8216;Arabee (d.543)<\/strong><\/p>\n<blockquote><p><strong>I know of no differing<\/strong> (amongst the scholars) over the intended meaning of <strong>&#8216;fee sabeelillaah&#8217;<\/strong> here (in the verse of zakaat,\u00a0Quran 9:60) that it refers to the battles (of the Muslim Army), and this is something done for Allaah&#8217;s pleasure, except that it is reported from Ahmad [ibn Hanbal]\u00a0and Is-haaq [ibn Raahwayh]\u00a0that they said it includes <strong>Hajj<\/strong>.<\/p><\/blockquote>\n<p><strong>Source:<\/strong> His book, <em>Ahkaam al-Qur&#8217;aan<\/em>, 2\/435.<\/p>\n<p><strong>4. Ibn Hubayrah (d.560)<\/strong><\/p>\n<blockquote><p><strong>The Imaams have agreed<\/strong> that it is not permissible to, nor is it valid to spend zakaat to build Masajid or bridges, or shroud the dead, or other (charitable) things, since zakaat was not legislated for that.<\/p><\/blockquote>\n<p><strong>Source:<\/strong> <em>al-Ifsaah<\/em>, as found in <em>Nayl al-Ma&#8217;aarib<\/em> of al-Bassaam, 2\/71.<\/p>\n<p><strong>5.
