And what do you know about the position of those who say that he has not caught that <em>rak&#8217;ah<\/em> and it must be repeated?<\/span><\/p>\n<p align=\"left\"><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\"><strong><span style=\"color: #006600;\">ANSWER<\/span><\/strong> by <a title=\"Biography: Shaykh Muhammad ibn \u2018Umar ibn Saalim Baazmool\" href=\"http:\/\/www.bakkah.net\/en\/biography-muhammad-umar-saalim-baazmool.htm\" target=\"_blank\">Shaykh Muhammad &#8216;Umar Baazmool<\/a>, Instructor at <a title=\"Umm Al-Qura University, Makkah, Saudi Arabia\" href=\"http:\/\/www.bakkah.net\/en\/umm-al-qura-university-makkah-saudi-arabia.htm\" target=\"_blank\">Umm Al-Quraa University<\/a> in Makkah<\/span><\/p>\n<p align=\"left\"><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\">This is an old issue, an issue of great differing amongst the scholars: Does the person who reaches the congregation during the <em>rukoo&#8217; <\/em>get credit for that <em>rak&#8217;ah<\/em> or not?<\/span><\/p>\n<p align=\"left\"><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\">The majority of the scholars<!--more-->, among them some of the senior Companions (may Allaah be pleased with them all), view that the <em>rak&#8217;ah<\/em> has been caught when one catches the <em>rukoo&#8217;<\/em>.<\/span><\/p>\n<p align=\"left\"><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\">Other scholars, some of the Companions as well, like Aboo Hurayrah (may Allaah be pleased with him), and like the great scholar Imaam Al-Bukhaaree, have understood that the <em>rak&#8217;ah<\/em> has not been caught in such a case. This position has also been attributed to Ibn Khuzaymah and his student, Aboo Bakr Ad-Duba&#8217;ee. Also, Taqee Ad-Deen &#8216;Alee ibn &#8216;Abdil-Kaafee As-Subkee supported Al-Bukhaaree&#8217;s position in a small book he wrote about this subject. Al-Mu&#8217;al-limee also chose this position and supported Al-Bukhaaree. And Shaykh Taqee Ad-Deen Al-Hilaalee also authored a small book in this subject, supporting the position of Al-Bukhaaree.<\/span><\/p>\n<p align=\"left\"><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\">They held the position that the<em> rak&#8217;ah<\/em> has not been caught by merely catching the <em>rukoo&#8217;<\/em>, and that a man absolutely must catch the <em>qiyaam<\/em> (standing) with the<em> imaam<\/em> and recite <em>Soorah Al-Faatihah<\/em>. This is due to his statement (<em>sallallaahu &#8216;alayhe wa salam<\/em>):<\/span><\/p>\n<p style=\"text-align: center;\" align=\"left\"><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\"><span style=\"color: #993300;\"><strong>\u0644\u0627 \u0635\u0644\u0627\u0629 \u0644\u0645\u0646 \u0644\u0645 \u064a\u0642\u0631\u0623 \u0628\u0641\u0627\u062a\u062d\u0629 \u0627\u0644\u0643\u062a\u0627\u0628<\/strong><\/span><br \/>\n<\/span><span style=\"font-family: Arial, Helvetica, sans-serif; color: #993300; font-size: medium;\"><strong>&#8220;There is no prayer for the one who does not recite the &#8216;Opening of the Book&#8217; <\/strong>(<em>Soorah Al-Faatihah<\/em>)<strong>.&#8221;<\/strong> <span style=\"color: #000000;\">[1]<\/span><\/span><\/p>\n<p align=\"left\"><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\">The generality of this hadeeth proves that a person has not caught the <em>rak&#8217;ah<\/em> if he has not recited <em>Soorah Al-Faatihah<\/em>.<\/span><\/p>\n<p align=\"left\"><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\">However, the majority of the scholars hold the position that such a person has actually caught the <em>rak&#8217;ah<\/em>, and that the <em>imaam<\/em>&#8216;s recitation of <em>Soorah Al-Faatihah<\/em> suffices the followers. Their proof for this is the hadeeth of Messenger (<em>sallallaahu &#8216;alayhe wa sallam<\/em>), when Aboo Bakrah Nufay&#8217; ibn Al-Haarith came to the masjid while the Messenger (sallallaahu &#8216;alayhe wa sallam) was making <em>rukoo&#8217;<\/em>. He (Aboo Bakrah) made <em>rukoo&#8217;<\/em> on his own before reaching the row, and then stepped forward until he reached the row. After the Messenger (<em>sallallaahu &#8216;alayhe wa sallam<\/em>) completed the prayer, he asked:<\/span><\/p>\n<p style=\"text-align: center;\" align=\"left\"><span style=\"color: #993300;\"><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\"><strong>\u0645\u0646 \u0647\u0630\u0627 \u0627\u0644\u0630\u064a \u0631\u0643\u0639 \u062b\u0645 \u0645\u0634\u0649 \u0625\u0644\u0649 \u0627\u0644\u0635\u0641\u061f<br \/>\n<\/strong><\/span><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\"><strong>&#8220;Who was the one who made <em>rukoo&#8217;<\/em> and then stepped up to the row?&#8221;<\/strong><\/span><\/span><\/p>\n<p align=\"left\"><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\">So Aboo Bakrah said, <em>&#8220;It was I, O Messenger of Allaah.&#8221;<\/em> So he said:<\/span><\/p>\n<p style=\"text-align: center;\" align=\"left\"><strong><span style=\"font-family: Arial, Helvetica, sans-serif; color: #993300; font-size: medium;\">\u0632\u0627\u062f\u0643 \u0627\u0644\u0644\u0647 \u062d\u0631\u0635\u064b\u0627 \u0648\u0644\u0627 \u062a\u0639\u062f<br \/>\n<\/span><\/strong><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\"><strong><span style=\"color: #663300;\">&#8220;May Allaah increase you in vigilance! Do not repeat <\/span><\/strong><span style=\"color: #663300;\">(that)<\/span><strong><span style=\"color: #663300;\">.&#8221;<\/span><\/strong> [2]<\/span><\/p>\n<p align=\"left\"><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\">So they say that the Messenger (<em>sallallaahu &#8216;alayhe wa sallam<\/em>) did not order him to make up that <em>rak&#8217;ah<\/em> that he caught when he made <em>rukoo&#8217;<\/em>. They say: <em>Laa yajooz ta&#8217;kheer al-bayaan &#8216;an waqtil-haajah.<\/em> [3] <\/span><\/p>\n<p align=\"left\"><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\">They also use another hadeeth that comes by a number of routes on the authority of Jaabir. Many of the scholars authenticated it (by way of its numerous routes). It is the hadeeth of the Messenger (<em>sallallaah &#8216;alayhe wa sallam<\/em>) when he said:<\/span><\/p>\n<p align=\"center\"><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\"><span style=\"color: #993300;\"><strong>\u0645\u0646 \u0643\u0627\u0646 \u0644\u0647 \u0625\u0645\u0627\u0645 \u0641\u0642\u0631\u0627\u0621\u0629 \u0627\u0644\u0625\u0645\u0627\u0645 \u0644\u0647 \u0642\u0631\u0627\u0621\u0629<br \/>\n&#8220;Whoever has an <em>imaam<\/em>, then the <em>imaam<\/em>&#8216;s recitation is his recitation.&#8221;<\/strong><\/span> [4]<\/span><\/p>\n<p align=\"left\"><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\">So they say that this hadeeth proves that the <em>imaam<\/em>&#8216;s recitation suffices the follower&#8217;s obligation to recite <em>Soorah Al-Faatihah<\/em>.<\/span><\/p>\n<p align=\"left\"><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\">This opinion is also aided by the fact that it is the reported position of Aboo Bakr As-Siddeeq, and &#8216;Umar as well, and a number of the senior Companions, like Ibn Mas&#8217;ood and others from the Companions known for their <em>fiqh<\/em>, may Allaah be pleased with them all.<\/span><\/p>\n<p align=\"left\"><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\">As for the opinion of Imaam Al-Bukhaaree, then he used the generality of the narrations of the Messenger (<em>sallallaahu &#8216;alayhe wa sallam<\/em>), and general principles understood from the narrations that order us to stand, recite <em>Soorah Al-Faatihah<\/em>, make <em>rukoo&#8217;<\/em>, and perform the rest of the pillars of the prayer.<\/span><\/p>\n<p align=\"left\"><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\">So they say a <em>rak&#8217;ah<\/em> that is missing two pillars, the pillar of <em>qiyaam<\/em> and the pillar of the recitation of <em>Soorah Al-Faatihah<\/em>, how could it be acceptable? So they judged, based on this, that the man who came and made <em>rukoo&#8217;<\/em> with the <em>imaam<\/em> has been credited with joining the congregation, <em>in shaa&#8217; Allaah<\/em>, but he did not catch that <em>rak&#8217;ah<\/em>. They say this is because he has not recited <em>Soorah Al-Faatihah<\/em> in this rak&#8217;ah, as the Messenger (<em>sallallaahu &#8216;alayhe wa sallam<\/em>) said:<\/span><\/p>\n<p align=\"center\"><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\"><span style=\"color: #993300;\"><strong>\u0644\u0627 \u0635\u0644\u0627\u0629 \u0644\u0645\u0646 \u0644\u0645 \u064a\u0642\u0631\u0623 \u0628\u0641\u0627\u062a\u062d\u0629 \u0627\u0644\u0643\u062a\u0627\u0628<\/strong><\/span><br \/>\n<span style=\"color: #993300;\"><strong>&#8220;There is no prayer for the one who does not recite the &#8216;Opening of the Book&#8217; <\/strong>(<em>Soorah Al-Faatihah<\/em>)<strong>.&#8221;<\/strong><\/span> [1]<\/span><\/p>\n<p align=\"left\"><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\">And also in the hadeeth of the one who prayed badly, when he taught the man to recite <em>Soorah Al-Faatihah<\/em> in every rak&#8217;ah, he then said (what means): <\/span><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\"><span style=\"color: #993300;\"><strong>&#8220;And do likewise in all of your prayers.&#8221;<\/strong><\/span> [5]<\/span><\/p>\n<p align=\"left\"><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\">This shows that a person is required to recite <em>Soorah Al-Faatihah<\/em> in each and every <em>rak&#8217;ah<\/em>. <\/span><\/p>\n<p align=\"left\"><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\">They also reply to those who use the hadeeth:<\/span><\/p>\n<p align=\"center\"><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\"><span style=\"color: #993300;\"><strong>\u0645\u0646 \u0643\u0627\u0646 \u0644\u0647 \u0625\u0645\u0627\u0645 \u0641\u0642\u0631\u0627\u0621\u0629 \u0627\u0644\u0625\u0645\u0627\u0645 \u0644\u0647 \u0642\u0631\u0627\u0621\u0629<br \/>\n&#8220;Whoever has an <em>imaam<\/em>, then the <em>imaam<\/em>&#8216;s recitation is his recitation.&#8221;<\/strong><\/span> [4]<\/span><\/p>\n<p align=\"left\"><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\">saying that this is for those who are actually praying behind him. So the one who joins during the <em>rukoo&#8217;<\/em>, he was not present when the<em> imaam<\/em> was reciting <em>Soorah Al-Faatihah<\/em>, so then the <em>imaam<\/em>&#8216;s recitation is not sufficient for him, thus nullifying their angle of proof from the narration.<\/span><\/p>\n<p align=\"left\"><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\">As for the narration of Aboo Bakrah Nufay&#8217; ibn Al-Haarith:<\/span><\/p>\n<p align=\"center\"><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\"><span style=\"color: #993300;\"><strong>\u0632\u0627\u062f\u0643 \u0627\u0644\u0644\u0647 \u062d\u0631\u0635\u064b\u0627 \u0648\u0644\u0627 \u062a\u0639\u062f<br \/>\n<\/strong><strong>&#8220;May Allaah increase you in vigilance! Do not repeat <\/strong>(that)<strong>.&#8221;<\/strong><\/span> [2]<\/span><\/p>\n<p align=\"left\"><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\">They responded with a number of replies:<\/span><\/p>\n<p align=\"left\"><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\">Firstly, this hadeeth is collected by Al-Bukhaaree in his book <em>Recitation Behind the Imaam<\/em> and by At-Tabaraanee in <em>Al-Mu&#8217;jam Al-Kabeer<\/em>, and it has an additional phrase. He said:<\/span><\/p>\n<p align=\"center\"><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\"><span style=\"color: #000000;\"><span style=\"color: #993300;\"><strong>\u0632\u0627\u062f\u0643 \u0627\u0644\u0644\u0647 \u062d\u0631\u0635\u064b\u0627 \u0648\u0644\u0627 \u062a\u0639\u062f\u060c \u0635\u0644 \u0645\u0627 \u0623\u062f\u0631\u0643\u062a \u0648\u0627\u0642\u0636 \u0645\u0627 \u0633\u0628\u0642\u0643<\/strong><\/span><br \/>\n<span style=\"color: #993300;\"><strong>&#8220;May Allaah increase you in vigilance! Do not repeat that. Whatever you have caught, then pray it; whatever you missed, then make it up.&#8221; <\/strong><\/span>[6]<\/span><\/span><\/p>\n<p align=\"left\"><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\">This authentic additional phrase has witnessing narrations in <em>Saheeh Muslim<\/em> and elsewhere to support it. For example, he (<em>sallallaahu &#8216;alayhe wa sallam<\/em>) said:<\/span><\/p>\n<p style=\"text-align: center;\" align=\"left\"><strong><span style=\"font-family: Arial, Helvetica, sans-serif; color: #993300; font-size: medium;\">\u0625\u0630\u0627 \u0646\u0648\u062f\u064a \u0628\u0627\u0644\u0635\u0644\u0627\u0629 \u0641\u0623\u062a\u0648\u0647\u0627 \u0648\u0623\u0646\u062a\u0645 \u062a\u0645\u0634\u0648\u0646 \u0648\u0639\u0644\u064a\u0643\u0645 \u0627\u0644\u0633\u0643\u064a\u0646\u0629 \u0641\u0645\u0627 \u0623\u062f\u0631\u0643\u062a\u0645 \u0641\u0635\u0644\u0648\u0627 \u0648\u0645\u0627 \u0641\u0627\u062a\u0643\u0645 \u0641\u0623\u062a\u0645\u0648\u0627<br \/>\n<\/span><\/strong><span style=\"font-family: Arial, Helvetica, sans-serif; color: #993300; font-size: medium;\"><strong>&#8220;If the prayer is established, then go to it and be peaceful. Whatever you catch, then pray it; whatever you miss, then complete it.&#8221;<\/strong> <span style=\"color: #000000;\">[7]<\/span><\/span><\/p>\n<p align=\"left\"><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\">They say that this order from the Messenger (<em>sallallaahu &#8216;alayhe wa sallam<\/em>) was already well established, so it shows something that it was repeated to Aboo Bakrah to explain what was upon him. So the Messenger (<em>sallallaahu &#8216;alayhe wa sallam<\/em>) said to him:<\/span><\/p>\n<p style=\"text-align: center;\" align=\"left\"><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\"><span style=\"color: #993300;\"><strong>\u0632\u0627\u062f\u0643 \u0627\u0644\u0644\u0647 \u062d\u0631\u0635\u064b\u0627 \u0648\u0644\u0627 \u062a\u0639\u062f\u060c \u0635\u0644 \u0645\u0627 \u0623\u062f\u0631\u0643\u062a \u0648\u0627\u0642\u0636 \u0645\u0627 \u0633\u0628\u0642\u0643<\/strong><\/span><br \/>\n<\/span><span style=\"font-family: Arial, Helvetica, sans-serif; color: #993300; font-size: medium;\"><strong>&#8220;May Allaah increase you in vigilance! Do not repeat that. Whatever you have caught, then pray it; whatever you missed, then make it up.&#8221; <\/strong><\/span><span style=\"color: #000000;\"><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\">[6<\/span><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\">]<\/span><\/span><\/p>\n<p align=\"left\"><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\">So based on this hadeeth, those who hold this second opinion that a person has not caught the <em>rak&#8217;ah<\/em> in this case, then he must stand up and pray that <em>rak&#8217;ah<\/em> when the <em>imaam<\/em> finishes.<\/span><\/p>\n<p align=\"left\"><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\">The <em>fatwaa<\/em> that we have here\u00a0is the position of the majority of the scholars. Shaykh Ibn Baaz, Shaykh Al-Albaanee, Shaykh Ibn &#8216;Uthaymeen, and other scholars, may Allaah have Mercy on the dead from them, and preserve those of them who are alive, have all issued this same verdict [that the <em>rak&#8217;ah<\/em> has been caught by catching the <em>rukoo&#8217;<\/em> with the imaam].<\/span><\/p>\n<p align=\"left\"><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\">The one I choose for myself is the position of Imaam Al-Bukhaaree, due to the generality of the texts. Imaam Ash-Showkaanee, may Allaah have Mercy on him, preferred the position of Al-Bukhaaree in <em>Nayl Al-Owtaar<\/em>. Although it appears he also has another statement about this issue elsewhere, this is still something found in <em>Nayl Al-Owtaar<\/em>, that the <em>rak&#8217;ah<\/em> has not been caught by merely catching the <em>rukoo&#8217;<\/em>.<\/span><\/p>\n<p align=\"left\"><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\">Shaykh Badee&#8217; Ad-Deen As-Sindee also wrote on this issue specifically. He also preferred the position of those who do not see that the <em>rak&#8217;ah <\/em>has been caught. He called this book <em>Al-Lum&#8217;ah fee &#8216;Adami Idraakir-Rukoo&#8217; liman adraka ar-Rak&#8217;ah<\/em>, or something like this.<\/span><\/p>\n<p align=\"left\"><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\">This issue, in reality, is an issue of great differing, and one that is difficult to conclude one way or the other. So the position that I have chosen for myself seeking the safest position, just as Shaykh Al-Mu&#8217;al-limee chose to safeguard himself, that the <em>rak&#8217;ah<\/em> is not caught merely by the catching of the <em>rukoo&#8217;<\/em>, due to the deficiency found, since two of the pillars of the prayer are missing: the pillar of <em>qiyaam<\/em> and the pillar of the recitation of <em>Soorah Al-Faatihah<\/em>.<\/span><\/p>\n<p align=\"left\"><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: medium;\">I also came across a book by Shaykh Muhammad Taqee Ad-Deen Al-Hilaalee on this same topic a while ago.
