QUESTION
If
a woman is granted a khula', can she then remarry her
ex-husband without first marrying and divorcing another man?
ANSWER
by Shaykh Muhammad 'Umar Baazmool, instructor at Umm Al-Quraa
University in Makkah
A
khula', a woman's requesting and being granted a divorce
from her husband, according to the scholars, is counted as
one divorce, and her 'iddah (period of post-divorce
waiting) for it is one menstrual cycle.
So,
if she has already been divorced twice, then this khula'
counts as the third divorce. Thus, she may not remarry
him until she marries (and divorces) someone else.
And
If this khula' has not been preceded by any other divorces,
or if it has been preceded by only one divorce, then she may
remarry her ex-husband without having married another man
first, and Allaah knows best.
